In April, 2011, SpeedGauge, Inc. brought a patent infringement lawsuit against inthinc Technology Solutions, Inc. alleging that the inthinc waySmart® and tiwi™ brands of products infringed U.S. Patent No. 7,356,392.  inthinc filed counterclaims against SpeedGauge for, among other things, infringement of inthinc’s U.S. Patent No. 7,859,392.  From the outset, inthinc publicly denied any liability in the lawsuit and proceeded to vigorously defend its products in Court.  

Last week, SpeedGauge agreed to dismiss its infringement claim against inthinc with prejudice.  Under the otherwise confidential terms of settlement, inthinc was not required to make any payment to SpeedGauge for its dismissal of the lawsuit against the accused waySmart and tiwi products.  In order to eliminate further expense and distraction, inthinc also dismissed its counterclaims against SpeedGauge in order to reach the settlement.

"We believed from the beginning that inthinc’s products did not violate the SpeedGauge patent and that this lawsuit was nothing more than a defensive act by an inferior single-feature provider,” said inthinc President and CEO, Todd Follmer. “Our belief about the case grew stronger with the claim construction and with every step in the litigation.  SpeedGauge's agreement to completely and finally dismiss the lawsuit, coupled with the fact that inthinc is not required to pay any money to SpeedGauge for dropping its claims against the waySmart and tiwi products, confirms in our minds what we believed all along and vindicates our decision to defend our products not only for ourselves but also for our current and future customers. Neither inthinc, nor any of its customers will ever be bothered again by nuisance claims from SpeedGauge when utilizing inthinc’s proprietary, best-in-class driver behavior management solutions.”

According to the National Highway Traffic Safety Administration, distracted driving accounts for one-third of all accidents on the road today. In 2011, 3,331 people were killed and 387,000 more were injured in incidents involving a distracted driver.

According to Lower Emissions and Particulates (LEaP), just 10 seconds of idling uses more fuel than restarting your engine. Despite this wasteful and environmentally harmful practice, many fleets have little to no enforcement policies when it comes to preventing drivers from idling.

With inthinc’s excessive idling alerts, fleet owners can manage a fuel-efficient and environmentally friendly fleet by customizing exactly when an idling alert is given to the driver—setting time limits for 30 seconds, one minute, or any other threshold. Tip #1 – Obey the Speed Limit

According to the U.S. Department of Energy, vehicles that honor the speed limit maintain a higher miles per gallon ratio. Each five mph increment driven over 60 mph is the equivalent of $0.31 per gallon of gas. With inthinc Speed-by-Street technology, drivers are verbally alerted when exceeding the posted speed limit.     

Tip #2 – Avoid Aggressive Braking and Accelerating

Not only does frequent braking and accelerating create wear and tear on vehicles, it also significantly decreases MPG. A 2011 study, by the University of Michigan Transportation Research Institute (UMTRI), has shown that by observing the speeding limit and avoiding hard braking and accelerating, drivers can improve MPG by as much as 25 percent. Tip #3 – Turn the Key: Eliminate Idle Time

One hour of idle time represents 80 miles of engine wear and approximately one gallon of fuel. By turning off the engine when not driving, fuel is conserved, engine wear is limited and carbon emissions are reduced. inthinc idle monitoring calculates the amount of time vehicles are left idling, allowing companies to identify areas where they can stop fuel waste. Additionally, managers can set time limits to alert drivers when they have been idling for too long.

Tip #4 – Check Your Vehicle Regularly

Checking tire pressure daily and replacing oil on time will ensure optimal performance. In anticipation of the Federal Motor Carrier Safety Association’s (FMCSA) recent ban on all cell phone use for commercial vehicles—and directly supporting the NTSB recommendation—inthinc developed the patented technology to help fleet managers remain compliant with federal regulations. “Accidents occur when there is a lack of safety controls,” said Corey Catten, CTO, inthinc Technology Solutions. “Our technology empowers fleet managers with the tools they need to improve driver safety and remain compliant with growing FMCSA regulations.”

CSA is an FMCSA initiative to ‘improve large truck and bus safety and ultimately reduce crashes, injuries, and fatalities that are related to commercial motor vehicles’. Within the Safety Measurement System (SMS), CSA scores are calculated using data from roadside inspections, including all safety-based violations, state-reported crashes, and the Federal Motor Carrier census to quantify performance in the Behavior Analysis and Safety Improvement Categories (BASICs).

Carriers receive points for infractions including speeding, reckless driving, improper lane change and inattention. Point values are determined based on the severity of the violation. In anticipation of the Federal Motor Carrier Safety Association’s (FMCSA) recent banon all cell phone use for commercial vehicles—and directly supporting the NTSB recommendation—inthinc developed the patented technology to help fleet managers remain compliant with federal regulations. If commercial carriers violate the federal rule, they may face fines of up to $11,000.

 “The Department of Transportation has made it clear that the responsibility rests with the carriers and that written anti-cell use policies are not sufficient preventive measures,” said Todd W. Follmer, CEO of inthinc Technology Solutions. “Distracted driving accounts for 16 percent of traffic fatalities; our cell detection service provides the only reliable detection technology in the market, allowing managers to be notified when a cell phone is being used and take appropriate action.”

Working closely with various federal entities, inthinc designed the cell and text detector according to specifications recommended by the FMCSA, National Transportation Safety Board (NTSB), National Highway Traffic Safety Administration (NHTSA) and the DOT. Integrated with inthinc’s comprehensive fleet management and driver safety solutions waySmart™ and tiwiPro™, the  new product detects cell phone waves emitted from the driver seat, warns drivers and passengers to terminate the use and reports it to the inthinc.com management portal or directly to a manager. This technology can decipher various wave frequencies including phone calls, text messages and emails. Managers may adjust the settings to either send an in-cab voice alert to drivers when a cell signal is detected, or quietly report the violation to the manager via email or text alert.

Software-based smartphone apps are also available as signal-blocking preventative measures, but may be limited to certain types of smart phones (typically BlackBerry only), or may be challenging to enforce from a management perspective. The inthinc directional antenna is a foolproof cell detection service, sending managers real-time automatic email notifications for cell phone use when drivers’ vehicles are in motion.

inthinc’s claims are brought as counterclaims to a lawsuit filed by SpeedGauge on April 18, 2011, alleging that inthinc’s Speed-by-Street feature infringes US Patent No. 7,356,392 owned by SpeedGauge. In its response and counterclaim, inthinc denies the SpeedGauge infringement claims and alleges that the SpeedGauge patent is invalid.

For example, if a fleet manager has vehicles operating in a region with no defined speed limits (such as a mining site or an oil and gas yard), smartZones technology allows the fleet manager to create speed limits for various parts of the area. If drivers exceed the assigned speed limit, they will receive an in-cab verbal notification asking them to slow down. Drivers may also receive verbal alerts for excessive idling, or upon entering or exiting a caution zone or hazardous area, leading to safer employees and decreased risk. “Along with our customers, we share a common concern and responsibility to reduce the impact commercial vehicles have on the environment,” said Corey Cattan, chief technology officer at inthinc. “Having a verbal alert for idling in commercial vehicles allows drivers to be aware of how long they have left their engine running and helps them stay aware of the environment—not to mention saving their organizations thousands of dollars in wasted fuel.”

Based on the type or purpose of the vehicle, fleet managers can customize when an idling alert is given. For example, if the vehicle is required to remain running in order to perform certain functions such as pumping fuel or running refrigeration, managers can adjust the alert sensitivity accordingly. For a delivery vehicle, on the other hand, the fleet manger can set alerts to occur at any number of 30-second intervals based on the average ‘delivery stop’ duration. 

Fleet managers can monitor idle time for each vehicle in their fleet via inthinc’s web-based management and reporting software. In addition to idling trends, the inthinc portal also provides team and individual driver scores for speeding, seat belt use, and aggressive driving, allowing fleet managers to reward top drivers or provide additional training for those who have lower scores. “inthinc saved my company,” said Don Macleod, owner of Southwestern Nevada LLC. “We were able to prove to the insurance company that they couldn’t find us negligible for something we weren’t at fault for. inthinc’s data and accident reviewing capabilities are the only reason we are in business today.”

Earlier this year, the Federal Motor Carrier Safety Administration (FMCSA) proposed a rule*that would require interstate commercial truck and bus companies to use an EOBR. • Slow down. Take particular care to reduce speed in general, but specifically on bridges, shaded areas, on curves and at night. These areas are colder and may have ice that is difficult to see.
• Avoid fatigued driving. The best way to combat fatigue behind the wheel is with rest. Opening the window and listening to loud music don’t really help, but even a short nap or break can go a long way towards fighting fatigue. When planning a long winter trip, plug in some extra time both to take into account weather conditions and in case you feel tired and need to stop and rest.
• Curb aggressive driving. Aggressive driving behaviors including hard braking, hard turning and rapid acceleration can be dangerous any time, but they are especially risky in wet and icy weather. Be patient, be prepared for slower traffic and don’t try to pass snowplows.
• Pay attention to the road. Distracted driving, particularly related to phone calls and texting, is rapidly contributing to more accidents each year. Pull over to talk or text or wait until reaching your destination to respond.
• Continually hone driving skills. Effective driver training solutions that can mentor and improve driving behavior have been proven to dramatically improve driving safety. Even the most seasoned driver can benefit from coaching, reminders and accountability for their driving actions.

Tip #2: Be a stellar example of safe driving yourself, and obey your own house rules. Believe it or not, your teen pays attention to your example, so wear your seatbelt, don’t drink and drive and put your cell phone away when driving.

Tip #3: Stay involved in your teen’s driving experience even when you’re not in the car with them. Be actively involved in the coaching and mentoring of your teen and monitor situations that might put them or other teens at risk. As Chad McCumbee and the No. 07 SS Green Light Racing team take to Texas Motor Speedway for this weekend’s Windstar World Casino 400k with sponsor tiwi  on board for the second- consecutive weekend, the secret is revealed.  

The green dot placed in the upper right-hand corner of the windshield is inthinc inc.’s tiwi brand logo placed on the lap counter which ensures accurate timing and scoring information for NASCAR. Although the logo is only apparent on the windshields in the Nationwide and Camping World Truck Series, the tiwi lap counter is also used by NASCAR in the Sprint Cup Series.

“We had a caution and that set up a green-white-checker finish. I spun the tires a little at the start and the driver behind me just flat ran me over and caused a big ole’ wreck."  

McCumbee achieved his first career top-10 at Texas Motor Speedway in the No. 07 Chevrolet in June 2006. In five starts on the 1.5-mile oval, he has two top-10’s with an average finish of 12.8. "We were good in this race last year,” said McCumbee. “The truck wasn't perfect but we got a sixth- place finish out of it. We are going to bring the same truck we finished third at California, sixth at Atlanta and eighth at Kansas with. I feel the SS Green Light team has been working really hard on this truck, and I think my team owner and the guys have found a few things to make it better. I'm hoping to put on a good show for our friends at tiwi Friday night."

Solid pit stops by the Green Light Racing team, patience, timely cautions and great driving were the keys to their success throughout the 200-lap race on the one-mile, concrete oval. By the time the green flag waved at 6 p.m., everyone forgot the race was delayed a day because of rain. 

McCumbee started his new association with inthinc and tiwi with a solid fifth-place qualifying effort. From the drop of the green, he would battle an ill-handling truck causing him to fall back in the field waiting for the mandatory caution on lap 45.  

However, some of McCumbee’s fellow drivers helped out by having problems of their own to bring out the caution earlier. This allowed team owner/crew chief Bobby Dotter to make some great calls for chassis adjustments, tires and fuel. 

Once those were made, McCumbee rallied back from 22nd to eighth in less than 15 laps. From there, Dotter and McCumbee kept relaying information back and forth to come up with the perfect combination. 

Even contact with another competitor near lap 65 didn’t deter their efforts, despite a whole in the front bumper. From the halfway point on, McCumbee never fell out of the top-10 as his black and lime green No. 07 tiwi.com Chevrolet moved from sixth to eighth to fourth to ninth in the running order.  

A late race caution left Dotter and McCumbee with two choices for the final lap 190 restart – pit for two right side tires, or stay out. Because they were running some of the fastest lap times during the final 50 laps, the decision was made to pit no matter what anyone else decided. Four of the top-10 contenders stayed out.  

When the green flag waved, McCumbee was ninth in the running order. After taking off fast and focused on flying to the front, he picked up two more positions to finish seventh.  

He and the No. 07 tiwi.com Chevrolet team remain eighth in driver’s points, but are now only four markers out of seventh, 30 from sixth and 140 to first place.  

Chad McCumbee, driver: “Wow, what a day – what a week. We weren’t even supposed to come to this race until the folks from tiwi and inthinc came on board. I can’t even begin to thank them for how they helped this team by coming on board to support our efforts this week.  

“As far as the race; we started off really crazy in how the truck was handling. But, leave it to Bobby Dotter to fix things by making the right calls. He is amazing at how he does things and the calls he makes in chassis and tire adjustments and how many tires to take when in incredible. That last stop could have gone either way, but when we saw two leaders have right fronts go down and they hit the wall, we knew we had to pit for two right-side tires. 

“We can’t afford to tear up a truck, plain and simple. So, pitting for two tires to keep us on the track and running at the finish was very important. The guys did what they had to do on pit road when it counted there at the end and I’m proud of them.  “Hopefully, this will keep us going in the right direction and we can remain in the points battle like we are right now.”.

She maintains ties to the university by participating on Radford’s President Advisory Council. She is a founding board member of the NASCAR Fuel for Business Council, which aids in driving business-to-business partnerships among official sponsors. She also serves as a committee member for the Autism Society of Delaware, helping raise funding and awareness for the Drive for Autism Research.

The company has added more than 100 employees over the past six months bringing the total employee count to about 400. The use of the lap counter builds on a seven-year relationship between inthinc and NASCAR. inthinc’s Witness Crash Data Recorder has been used in all NASCAR series since 2002 to record driving data and improve car and driver safety. The data collected has been instrumental in equipment and track improvements and in the development of the COT (“Car of Tomorrow”).

NASCAR’s primary lap counter utilizes an inductive loop system on the start/finish line, which sends and receives a signal to and from a transponder in each car. The tiwi system uses GPS and mapping technology to create a series of zones around any track and counts each time a car passes through specified zones, ensuring a high level of lap counting accuracy. The current backup system requires a member from each team to sit close to the track with a clear view of the start/finish line. Following a successful pilot program of the tiwi device, NASCAR will have the availability of these prime viewing locations at each track.

The tiwi product will soon be released for consumers as a teen driving safety solution that mentors young drivers to dramatically improve driving skills, reduce accidents and increase teen safety. 

The Witness™ has been used for several years in the United States in NASCAR’s top 3 sanctioned racing series (Sprint Cup, Nationwide, and Craftsman Trucks) and has contributed to safety improvements through that sport.  Implementation of the Witness™ is the next step in a long line of measures the U.I.M. has taken to improve safety for its racers.

The 16-foot long carbon fiber catamarans rocket around a circuit at speeds topping 225kph (130mph). The Witness records the dramatic forces acting on a boat in a crash. Following a crash, the recorded data can be immediately accessed and analyzed. The information is then compiled and examined to help design even safer boats and more effective safety devices. All data is stored by inthinc and available for analysis through a web-enabled portal.

The Witness™ is virtually maintenance-free and is self-powered with a battery life of several years. It objectively measures the magnitude and direction of the forces experienced in a crash.
